Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Eat Play St. Pete mobile app and venue owner dashboard at dashboard.eatplaystpete.com (together, the "Service"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who Can Use the Service

You must be at least 13 years old to use the consumer app. Venue owner accounts require an authorized representative of the business. By using the Service, you confirm you meet these requirements.

2. Accounts

You're responsible for your account, including keeping your password secure and for all activity that happens under your account. Let us know immediately at info@eatplaystpete.com if you suspect unauthorized access.

3. Subscriptions

Consumer — Eat Play St. Pete Pro (in-app purchase)

Eat Play St. Pete Pro is an auto-renewable subscription billed through Apple at the price shown in the app at the time of purchase.
Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage or cancel your subscription anytime in your Apple ID account settings. Cancellations take effect at the end of the current billing period.
No refunds for partial billing periods unless required by law. Apple handles billing disputes per its Media Services Terms.

Venue Owner — Venue Pro ($29 / month)

Venue Pro is a monthly subscription billed through Stripe at $29 USD per month. Listings go live in the app once billing is active.
Your subscription renews automatically every month unless cancelled. You can cancel anytime in the billing portal accessible from your dashboard Settings.
If a payment fails, Stripe will automatically retry. If we can't collect, we may suspend or remove your listing.
Cancellations take effect at the end of the current billing period. We don't refund partial months unless required by law.

4. Acceptable Use

You agree not to:

Use the Service for unlawful purposes, or in violation of these Terms.
Misrepresent your identity, or claim a venue you don't own or aren't authorized to manage.
Submit inaccurate, misleading, or harmful content.
Scrape, copy, or reproduce the Service or its content except as permitted.
Interfere with the Service, attempt to gain unauthorized access, or abuse rate limits.
Harass other users.

We may suspend or terminate accounts that violate these terms.

5. Venue Listings & Content

If you're a venue owner, you grant us a non-exclusive, royalty-free license to display the listing content you provide (name, photos, descriptions, deals, events, hours) inside the Service. You represent that you have rights to all content you submit and that it's accurate. We may remove content at our discretion if it violates these Terms or applicable law.

6. Reviews

Reviews you submit should reflect your honest opinion. We may remove reviews that are abusive, defamatory, off-topic, fake, or that violate applicable laws.

7. Intellectual Property

The Service, including its design, code, branding, and curated content, belongs to Eat Play St. Pete. You retain ownership of content you submit, subject to the license you grant us above to display it.

8. Third-Party Services

The Service relies on third-party services (Apple, Google, Stripe, Supabase, RevenueCat, Resend, Cloudflare). Their terms and privacy policies also apply when you use those parts of the Service.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or meet your specific needs. Information about venues, hours, prices, and events is provided by venue owners or third parties and may be inaccurate or out of date.

10. Limitation of Liability

To the maximum extent permitted by law, Eat Play St. Pete and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Eat Play St. Pete from any claims arising out of your use of the Service, your content, or your violation of these Terms or any law.

12. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access for any reason consistent with these Terms, including violation of acceptable use.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Pinellas County, Florida.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Continued use after changes constitutes acceptance.
